Legal Framework
The local fee for municipal waste and small construction waste is regulated by Act No. 582/2004 Coll. on local taxes and local fees for municipal waste and small construction waste. This law establishes local taxes and fees that can be imposed by a city, municipality, or higher territorial unit. The local fee is imposed by the municipality (tax administrator) and is revenue for its budget.
The municipality collects fees in two ways: a flat fee per person per year, or based on the volume of waste produced (quantity-based collection). For quantity-based collection, the municipality allows citizens to individually determine the collection interval or choose the size of the waste container from at least three categories.
Municipal waste fee — in detail
The fee is charged for municipal waste and minor construction waste generated within the municipality.
Municipal waste includes:
- household waste generated within the municipality (excluding waste from business activities),
- waste from properties used for recreation — gardens, cottages, holiday homes, garages, garage and parking spaces,
- waste from cleaning public roads and spaces, maintaining greenery, parks and cemeteries.
Minor construction waste:
Waste from routine maintenance work carried out by or for a natural person. The municipality must ensure collection of up to 1 m³ per person at least twice a year (if quantity-based collection is not in place).
The municipality may not include in the fee the costs of:
- electrical and electronic waste, used batteries and accumulators,
- packaging and non-packaging product waste — paper, plastics, glass, metals (separate collection).
